Terms of Use

This document is an electronic record in terms of the Information Technology Act, 2000 and rules made thereunder and does not require any physical or digital signatures. By accessing or using the Platform, users agree to these Terms of Use in electronic form.

The Platform is owned by Swaraaj Ecosystem Private Limited (hereinafter referred to as “Handmark”), a company incorporated under the Companies Act, 1956, having its registered office at:

Your use of the Platform, services, and tools is governed by these Terms of Use, which also include any applicable policies referenced herein. By using the Platform, you acknowledge that these Terms and related policies form a binding contract between you and Handmark.

Definitions

• “Platform” refers to the Handmark website, mobile application, and related services.
• “Handmark”, “we”, “us”, “our” refers to the owner and operator of the Platform.
• “User”, “Customer”, “you” refers to any person accessing or using the Platform.
• “Seller” means independent artisans or businesses listing products on the Platform.
• “Product(s)” refers exclusively to handmade goods listed on the Platform.
• “Order” refers to a purchase request placed by a User through the Platform.

Acceptance of Terms

By accessing, browsing, or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms of Use along with all applicable policies, including the Privacy Policy, Cancellation Policy, and Refund Policy. If you do not agree, you must discontinue use of the Platform.

Eligibility

You represent that you are legally competent to enter into a binding contract under applicable laws. Use of the Platform is not permitted where prohibited by law.

Platform Role Disclaimer

Handmark is an intermediary marketplace platform facilitating transactions between buyers and independent sellers.

Handmark does not manufacture, own, store, or control any products listed on the Platform and is not a party to the contract of sale between buyers and sellers. The contract of sale exists solely between the buyer and the seller.

Scope of Services

Handmark provides a digital platform for discovery, listing, and sale of handmade products.

Due to the handmade nature of products, minor variations in size, color, texture, or finish are natural and shall not be considered defects. Product images are illustrative and may differ slightly from the delivered product.

User Account Responsibilities

Users may be required to provide accurate personal and contact information. You are responsible for maintaining the confidentiality of your account credentials. Handmark shall not be liable for unauthorized access caused by user negligence.

Product Listings & Availability

All product listings are subject to availability. Handmark reserves the right to modify, discontinue, or limit quantities without prior notice. Handmade production timelines may vary depending on design complexity and material availability.

Pricing & Taxes

Prices are displayed as inclusive or exclusive of applicable taxes as stated on the Platform. Delivery charges, if applicable, are shown at checkout. Price changes shall not affect confirmed orders.

Payments

Payments are processed through authorized banking and payment partners. For customized products, a 50% advance payment is required at the time of order placement. Orders are processed only after successful payment confirmation.

Order Confirmation and Processing

Order confirmation does not guarantee acceptance. Handmark reserves the right to cancel orders due to pricing errors, stock issues, or suspected fraud. In such cases, any paid amount shall be refunded as per the applicable policy.

Cancellation and Refund Policy

For customized products, the 50% advance payment becomes non-refundable after 24 hours from order placement. Orders cancelled within 24 hours are eligible for a full refund. Cancellations made after 24 hours shall not be eligible for a refund of the advance payment.

Refunds are processed through the original payment method within a reasonable timeframe.

Delivery Policy

Delivery timelines are estimates and may vary due to handmade production or logistics constraints. Handmark shall not be liable for delays caused by logistics partners or circumstances beyond reasonable control.

If delivery is refused, applicable delivery charges shall be deducted and the remaining balance shall be credited as per the return policy of the respective product.

Force Majeure

Handmark shall not be liable for delay or failure in performance caused by events beyond reasonable control, including natural disasters, acts of God, government actions, strikes, logistics disruptions, or internet outages.

Returns and Exchanges

Due to the customized and handmade nature of products, returns and exchanges may be restricted.

Any issues related to damaged or incorrect products must be reported within the timeframe specified on the Platform. Handmark reserves the right to inspect returned items before approving refunds or replacements.

Intellectual Property Rights

All content on the Platform, including text, images, logos, designs, trademarks, and software, is the intellectual property of Handmark or its licensors. Unauthorized use, reproduction, or distribution is strictly prohibited.

User Conduct and Prohibited Activities

• Violation of applicable laws or regulations
• Providing false or misleading information
• Interfering with the security or functioning of the Platform
• Infringing intellectual property or privacy rights

Handmark reserves the right to suspend or terminate access for violations.

Limitation of Liability

To the maximum extent permitted by law, Handmark shall not be liable for indirect, incidental, or consequential damages. Minor handmade variations do not constitute grounds for claims. Total liability shall not exceed the amount paid for the relevant order.

Indemnification

You agree to indemnify and hold harmless Handmark from any claims, damages, losses, or expenses arising from your misuse of the Platform or violation of these Terms.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Courts located in Ahmedabad, Gujarat, shall have exclusive jurisdiction.

Amendments

Handmark reserves the right to amend these Terms of Use at any time. Continued use of the Platform constitutes acceptance of the revised Terms.
